Confessions of a CMO Online Participant Terms - Worldwide Partners

Thank you for participating in the Confessions of a CMO program with Worldwide Partners, Inc. (“we” or “us”). The following terms and conditions govern the submission of your testimonial and other materials (collectively, “Submission”) that you provide through the form on our website confessionsofacmo.com. You agree that your Submission is further governed and protected by the terms of our Privacy Policy.

1. You are allowing us, our affiliates, subcontractors, successors, assigns, agents, partners, subsidiaries, and employees to use your Submission in our Confessions of a CMO program, which provides insight to marketers and agencies as to the observations, thoughts, and opinions of marketing leaders or their counterparts (the “Program”).
2. You understand that your identity, including your name, image, and any identifying features will remain confidential unless you expressly allow us to use them. To the extent you do allow us to use them, you give us our affiliates, subcontractors, successors, assigns, agents, partners, subsidiaries, and employees permission to use them solely in connection with your Submission.
3. Upon submitting the Submission to us, you understand that we will own your Submission and the intellectual property rights in the Submission. You are allowing us to edit or modify the Submission as needed for our program (without materially changing the Submission), and you understand that your Submission will be displayed publicly in connection with our Program.
4. You understand Artificial Intelligence may be used in connection with your anonymized Submission.
5. You agree to be honest and truthful in your Submission, and you agree that your Submission will not violate the privacy or confidentiality of any person or entity. You also agree not to include any identifying information in your Submission, and if you accidentally do so, you will tell us immediately so that we can remove it. If the Submission has already been published, we will endeavor to redact what we can, but this may not be possible.
6. We indemnify, defend, and hold you harmless for any third-party claims arising out of (i) our use of the Submission, (ii) our negligence, our (iii) willful misconduct, or our breach of these terms, except to the extent that you have breached any of these terms. You release us from any liability concerning the information contained in your Submission, provided we have remained compliant with these terms.
7. You represent and warrant that you are at least 18 years of age, that you have the full right, power, and authority to agree to these terms. If any disputes arise out of these terms or the Program, you agree that the dispute will be resolved in Denver, Colorado.
